A waste of time? - JSOnline
"So was it worth it? Probably not. As it appeared from the beginning, it appears even more so now that nothing will change in the election for state Supreme Court.
With 71 counties recounted — Waukesha County has until May 26 to finish — JoAnne Kloppenburg has reduced David Prosser’s 7,316 vote lead by 355 votes. She won’t pick up the rest in Waukesha County. (The recount Monday at the Waukesha County Courthouse is pictured above.)
Kloppenburg had every right to request the recount, but given the cost and the political fallout, it would have been better had she graciously accepted the loss. And — although again she has every right to do so — it would be better if she didn’t challenge the outcome in court, which it appears she will do. In fact, it appears the recount was mere preamble to the court challenge. This is no way to run an election.

Chain of custody violations continue to emerge, particularly in Waukesha, during state Supreme Court election 'recount'
Five out of six bags of ballots from first batch to be counted out of the City of Brookfield in Waukesha County, WI, today were discovered "almost wide open" during Day 9 of the statewide Supreme Court election "recount." WAUKESHA--On Friday, day three of the statewide recount of the Supreme Court race, the Kloppenburg recall effort called in their attorney, Michael Maistelman, to monitor the recount in Waukesha County.
Earlier Friday a clerk discovered that one of the bags full of ballots from the Town of Delafield was not properly sealed. The Kloppenburg campaign said that means there was the possibility that people could have had access to the bag of ballots. On Thursday, a different bag containing hundreds of ballots wasn't recorded on the poll inspector's log. That bag was also from the Town of Delafield.
Despite that, poll officials promise the numbers all added up to those obtained on election night. Still, the Kloppenburg campaign sent Maistelman to oversee the recount."Full Article | WTMJ | Local News

WI Supreme Court candidate JoAnne Kloppenburg has until close of business on Wednesday, April 20, 2011, to request a statewide, full recount of all ballots cast in the April 5th Supreme Court election.
The race was close. With a total of approximately 1.5 million votes cast, Mr. Prosser, the conservative, pro-business incumbent, is in the lead by less than half of one percent of the vote (0.5%).
The suspicious handling of votes in conservative Waukesha county is one matter of concern to all who fight for fair elections. But the other issue is this: people do make mistakes in filling out their ballots. When a race is this close the only way to determine who absolutely won is to review all ballots cast with human eyes and resolve any disputes over ballots that are questionable.
As a candidate I have been through one recount. As a candidate's representative I have been through another recount. Mistakes happen in completing ballots. When in doubt and in very close races the only way to obtain certainty, as to who won "fair and square," is to conduct a full recount.

YouTube - HUMAN ERROR OR FOUL PLAY IN WISCONSIN RACE ?
Just yesterday JoAnne Kloppenburg was projected the winner by the AP, by 200 votes against Justice David Prosser, in what was seen as proxy race . That is until a County Clerk named Kathy Nickolaus managed to misplace a whole town's votes . And this town happened to be in a largely Republican district . This is unprecedented in this town and Kathy Nickolaus has been the subject of many complaints from other Waukesha officials on how she handles elections and keeps public information to herself outside the official county system where others can verify it . In addition, other suspicious questions are raised. (1) The suspicions due to the fact that the " discovery " not only swung the election but also put the race just barely past the amount needed to trigger a state-financed recount . (2) Nickolaus waited 24 hours to report the discovery . This makes it harder it harder to challenge and audit the integrity of the vote . (3) The partisan political history of Nickolaus and complaints . (4) Posser is a former boss of Nickolaus . Although this could just be in fact human error, there are far to many suspicious coincidences for there not to be an investigation . The group Citizen Action of Wisconsin is calling for an immediate federal investigation and impoundment of all computer equipment, ballots, and other relevant evidence needed to verify a fair vote count in Waukesha County. Kloppenburg campaign manager Melissa Mulliken, has started the process hiring the national law firm Perkins Coie -- which has an office in Madison, Wis. For further information use link below .

Kloppenburg's campaign is working with Marc Elias, an attorney with Perkins Coie, a Washington D.C.-based firm with an office in downtown Madison. Elias is the same attorney who represented Democratic challenger Al Franken in his eight-month epic recount battle with incumbent Republican Norm Coleman. Franken eventually prevailed, winning his U.S. Senate seat by 312 votes.

A contest for the Wisconsin Supreme Court that some voters viewed as a referendum on the state’s Republican leaders and their cuts to collective bargaining rights remained in a virtual tie Wednesday morning....
"Until emotions boiled over in the state capital weeks ago on questions over labor unions, public workers and budget cutting, Justice David T. Prosser, who was seen by some as part of a conservative majority on the court, had been widely expected to coast to a second 10-year term.
But election officials reported an extremely tight race as Tuesday night wore on, with a higher than expected turnout: Justice Prosser was in a dead heat with JoAnne Kloppenburg, an assistant attorney general who was not widely known through the state before this race. With all but a few of the state’s voting districts reported Wednesday morning, Ms. Kloppenburg was leading by 311 votes among more than 1.4 million cast. The leader had flipped again and again throughout the night on Tuesday."
